Our services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL), Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these terms excludes, restricts, or modifies the application of any statutory consumer guarantees or any other rights and remedies available to you under the ACL or any other applicable law.
Where a service fails to conform to a consumer guarantee under the ACL, you are entitled to a remedy to the extent required by law, which may include a refund, resupply of the service, or compensation for damages.

Fees for our services are as stated in your service agreement or quotation. Payment terms are outlined at the time of booking. You may cancel a scheduled session with at least 24 hours' notice. Late cancellations or no-shows may incur a fee as agreed in your service terms. Refund requests are assessed in accordance with the Australian Consumer Law.
Our fitness programs are designed for generally healthy individuals. If you have a pre-existing medical condition, injury, or are returning to exercise after a prolonged period of inactivity, we recommend consulting a qualified healthcare professional before beginning any new fitness program. XCD Fitness Pty Ltd provides general fitness guidance and is not a substitute for medical advice.
We reserve the right to suspend or terminate your access to our services or website at any time, without notice, if you breach these terms, engage in unlawful or abusive behaviour, or pose a safety risk to yourself or others. Upon termination, any outstanding fees remain payable, and we will refund any prepaid services for sessions not yet delivered, in accordance with the ACL.
These Terms of Service are governed by and construed in accordance with the laws of the State of Western Australia. You irrevocably submit to the exclusive jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts for any dispute arising out of or in connection with these terms.
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated revision date. Your continued use of our website and services after changes are published constitutes your acceptance of the revised terms.
